How to Avoid Unnecessary Expenses
Video Transcribed: Good day, everybody. This is Dustin Peterson, and I am a lawyer in Oklahoma. Several times a month, I will be bringing to you the answers to the most commonly heard questions and concerns from my clients, and hopefully, you can use that information to make better decisions in your own situation.
Today’s question, I would like to divorce my husband because he had an affair. Will I get more in property because of his infidelity? These are never easy. Always very painful. Unfortunately, the answer here is probably not. In Oklahoma, we are a no-fault divorce state, and although there are 12 statutory grounds for divorce, of which adultery is one, most people stick to the incompatibility grounds or reconcilable differences simply because there’s no reason to dig that up.
One, it gets expensive because when you start throwing mud at your spouse, they’re going to throw it back, and once you drag your attorneys into that, it causes unnecessary stress and time for everybody, which will get expensive for you. So, I would suggest that you stick to the incompatibility grounds, get through that process, and perhaps if you have minor children involved and custody becomes an issue, that is sometimes where those other grounds come in and that’s where it can get messy, but if you have questions for an Oklahoma City divorce attorney about the grounds for divorce in Oklahoma, please give me a call at (405) 888-5400, or simply look me up online at TheOklahomaCityAttorney.com.
