Today’s question is, “My spouse has drug problems and domestic abuse issues. Although we live in Texas, I have taken our child and come to Oklahoma where I have more family, and I would like to file for divorce here in Oklahoma.:
Well, I have bad news, unfortunately. Oklahoma statutes require six months of residency before you can file for divorce. You are most aided in your search for an attorney in Texas, who can first advise you on what you might need to do there. But here what’s going to happen, most likely, is your spouse is going to get upset back home, they’re going to file something in Texas, and it’s going to drag you right back there to respond to it. Especially with the custody concerns. That will be a big issue.
